1. Acceptance of Terms

By downloading, installing, or using the Are you OK mobile application ("App") or accessing our website at areyouok.social ("Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App or Website.

These Terms constitute a legally binding agreement between you ("User", "you") and Truemium OÜ ("Company", "we", "us"), a private limited company registered in Estonia, with its registered address at Paavli tn 5a/1, Tallinn 10412, Estonia.

2. Description of Service

Are you OK is a safety check-in application that allows users to:

  • Set scheduled check-in times to confirm their well-being
  • Designate emergency contacts who are automatically notified if a check-in is missed
  • Share location data with designated emergency contacts

Important: Are you OK is NOT an emergency service. It is not a substitute for calling emergency services (such as 112, 911, or local equivalents). In case of an emergency, always contact your local emergency services first.

3. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you must have the consent of a parent or legal guardian. By using the App, you represent and warrant that you meet these requirements.

4. User Accounts

The App supports the following authentication methods:

  • Device-based authentication: An anonymous account is automatically created using your device's unique identifier. No personal information is required.
  • Social authentication: You may optionally link your account with Apple Sign-In or Google Sign-In for account recovery and cross-device access.

You are responsible for maintaining the security of your device and account. You agree to notify us immediately of any unauthorized access to your account.

5. Subscriptions and Payments

5.1 Free Tier

The App offers a free tier that includes:

  • 1 check-in schedule
  • 1 emergency contact
  • Push notification reminders
  • Activity history

5.2 Premium Subscription (Are you OK Pro)

Premium features include unlimited schedules, multiple emergency contacts, location sharing, and priority notifications. Premium subscriptions are managed through Apple App Store or Google Play Store via RevenueCat.

5.3 Billing and Cancellation

  • Subscriptions are billed according to the pricing displayed at the time of purchase.
  • A 7-day free trial is available for new subscribers.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • Cancellation and refund policies are governed by the Apple App Store or Google Play Store terms, as applicable.
  • You may manage or cancel your subscription through your device's app store settings.

6. User Responsibilities

By using the App, you agree to:

  • Provide accurate and up-to-date information for your emergency contacts
  • Obtain consent from individuals before adding them as emergency contacts
  • Not use the App for any unlawful or malicious purpose
  • Not attempt to disrupt, hack, or reverse-engineer the App
  • Understand that the App is a supplementary safety tool and not a replacement for professional emergency services

7. Emergency Contact Consent

When you add an emergency contact, they will receive a verification message (via SMS or email) to confirm their consent. Emergency contacts have the right to:

  • Decline to be an emergency contact
  • Revoke their consent at any time
  • Request removal of their personal information

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The App is provided "as is" and "as available" without warranties of any kind.
  • We do not guarantee that notifications (SMS, email, or push) will be delivered successfully in all circumstances. Delivery depends on network conditions, device settings, and third-party service availability.
  • We are not liable for any actions taken or not taken by you, your emergency contacts, or any third party based on notifications sent or not sent through the App.
  • We are not liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the App.
  • Our total liability to you shall not exceed the amount you have paid for the App in the 12 months preceding the claim.

9. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, and software, are the exclusive property of Truemium OÜ and are protected by international copyright, trademark, and other intellectual property laws.

10. Termination and Account Deletion

You may delete your account at any time through the App settings. Upon account deletion:

  • Your personal data will be permanently removed in accordance with our Privacy Policy.
  • Active subscriptions should be cancelled separately through your app store.
  • Your emergency contacts will no longer receive notifications on your behalf.

We reserve the right to suspend or terminate your access to the App if you violate these Terms or engage in harmful behaviour.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or via the email associated with your account. Your continued use of the App after such changes constitutes acceptance of the updated Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Estonia and the European Union. Any disputes arising from these Terms shall be resolved in the courts of Tallinn, Estonia, unless mandatory consumer protection laws in your jurisdiction provide otherwise.
